Assisting a buyer, but acting for the vendor? If the agency interest is blurred, so are your obligations.

Buyer’s agents must be licensed, and they are bound by the Real Estate Agents Act 2008 and the Real Estate Agents Act (Professional Conduct and Client Care) Rules 2012 (Code of Conduct).

An agency agreement is the key. Section 126 states no commission or expenses are payable by a client without an agency agreement—so a buyer’s agent must not act for a buyer unless authorised in writing.

Rule 11 also sets out specific client/customer care obligations for buyer’s agents.

And if you are assisting a buyer while acting for the vendor, it must be made clear to the buyer whose interest you are serving, so the fiduciary duties are not compromised.

If you’re carrying out real estate agency work under the Real Estate Agents Act 2008, you must be licensed—whether you act for a buyer or a seller. But buyer’s agency is paid for by the buyer, and it must be carried out under an agency agreement.

Section 126 is direct: commission or expenses from a client are not entitled to without an agency agreement. So a buyer’s agent should not act for a buyer unless authorised by a written agency agreement.

Buyer’s agents can’t operate “by default”. If real estate agency work is carried out under the Real Estate Agents Act 2008, licensing requirements still apply whether you act for a buyer or seller.

Buyer’s agent work is done for the buyer and paid by the buyer—under an agency agreement.

The chance of buying a property where methamphetamine has been produced or smoked in large quantities is very low.

However, if there’s a strong suspicion (or police have advised) that a property was used for methamphetamine production, testing may be considered—and a satisfactory result should be built into the offer as a condition.

A common benchmark: a property that tests below 15 micrograms per 100cm2 is considered safe to live in with no adverse health effects.

Testing should be approached carefully too. If contamination testing is planned, it’s important to note that the testing industry isn’t currently regulated in New Zealand.

If concern remains, talk to your lawyer before making an offer.
