Acceptance
1.1 In N Out Mobile Pty Ltd will repair the provided device in accordance with the agreement made overleaf. Unless the device being repaired is under existing warranty, full payment is required prior to collection of the device.
1.2 You, as the customer, understand and agree that any repairs undertaken by In N Out Mobile Pty Ltd will void the manufacturer’s w
arranty on your device
1.3 In N Out Mobile Pty Ltd reserves the right to use any third-party repairer at any time without consent of the customer provided it does not exceed the agreed price estimate as per cl.2.2
Cost Estimates
2.1 The repair costs stated in cost estimates are guidelines estimated on the basis of the information you provide and following the examination of the device.
2.2 We cannot guarantee the accuracy of the figures contained. If while repairing the device it becomes clear that more extensive repair work is necessary, we are authorized to complete the work without seeking confirmation from you, provided this does not cause the overall repair costs to exceed the estimated price by more than 15%. Otherwise we will inform you that we expect the cost estimate to be exceeded and will present a new estimate to you.
2.3 If, based on a cost estimate, you decide not to proceed with the performance or continuation of the repair work, we are entitled to charge for any services performed up to that point. Remuneration
3.1 Our remuneration for the repair work is calculated based on the individual services performed. Our rates applicable at the time of the repair will be charged. Collection
4.1 Collection of your device is subject to full payment being received by In N Out Mobile Pty Ltd prior to its release.
4.2 You must collect your device from In N Out Mobile Pty Ltd within 60 days of being notified by In N Out Mobile Pty Ltd that your device has been repaired and is ready for collection.
4.3 If you do not collect your device within this period, In N Out Mobile Pty Ltd will consider your device abandoned and will provide you with notice to that effect. If In N Out Mobile Pty Ltd considers your device abandoned and provides you with notice to that effect, In N Out Mobile Pty Ltd may, subject to any applicable provisions of law, dispose of your device in any manner. Terms of Payment
Our invoices are due without any deductions as soon as we have provided the repair work and issued an invoice. Payment is required to be made in only the following methods: Cash, EFTPOS. In situations requiring the special ordering of parts not held in inventory, a deposit may be required prior to such an order being made. Risk
Repairs on mobile devices carry and inherent risk of further damage, data loss, and/or, device failure. The customer agrees to have this repair performed at their own risk. Liability
In N Out Mobile Pty Ltd is not responsible for the unavailability of parts or delays in parts shipment beyond their control. In N Out Mobile Pty Ltd is not responsible for any data loss that may occur in shipping, during the repair process, or at any other time. In N Out Mobile Pty Ltd cannot guarantee the security and/or privacy of your data. In the case of accidental data loss or damage to your system, or, damage or, data loss caused by existing problems in your system such as viruses, misconfigured software, jailbreak or hardware problems/failures, you agree to hold In N Out Mobile Pty Ltd and any persons associated with or involved in the work being done for you, harmless from any action, claims, liability or loss in respect of such data loss or damage. If any device is damaged or lost while in In N Out Mobile Pty Ltd custody, In N Out Mobile’s liability will be limited to the cost of repairing the affected device or providing you with a replacement. In N Out Mobile Pty Ltd takes all reasonable steps and due care to avoid damage to devices in our care. In N Out Mobile Pty Ltd takes no responsibility or liability for damages that may occur whilst in our care, caused by any other means than intent, gross negligence or malpractice. To the maximum extent permitted by law, In N Out Mobile Pty Ltd is not liable for any special, indirect, incidental or consequential damages resulting from the performance of any repair services. In N Out Mobile Pty Ltd maximum liability for any and all damage shall not in any event exceed the payments received by In N Out Mobile Pty Ltd for services provided pursuant to these terms and conditions. Water damaged device repairs are not under any warranty and repairs may cause data loss in such devices. If your device is in a condition that restricts us to investigate any existing problems, we are only responsible for providing you with the repairs you demand. In N Out Mobile Pty Ltd is not liable for any existing issue other than the repairs that were agreed upon. In the event that damage is sustained by a device in our care as a result of malpractice, intent, or negligence, In N Out Mobile Pty Ltd will, at our cost, repair or replace any part, or component of the device, or the device itself, in whole or in part as determined necessary by In N Out Mobile Pty Ltd. Warranty
In N Out Mobile Pty Ltd warrants all parts and workmanship with three (3) months warranty. If, during this time, the device displays faulty behavior as a result of defect in the part, or due to poor workmanship, In N Out Mobile Pty Ltd will replace the part, or perform repair, at no cost to the customer.
