The European Commission has issued fines totaling €875 million for anti-competitive conduct in the automotive sector.

The case involved coordinated limitations on the development of emission-cleaning technologies for diesel vehicles - marking the first time the Commission has sanctioned a cartel for restricting innovation, rather than for price-fixing or market sharing.
Between 2009 and 2014, several companies exchanged technical information and agreed not to compete on improving certain environmental technologies, despite having the capacity to do so individually.
This decision underscores that even coordination on technical matters can constitute a breach of EU competition law when it undermines innovation and consumer benefit.

EU Launches InvestAI Initiative:
€200 Billion to Boost AI in Europe's Businesses

The EU is making a strong commitment to artificial intelligence: At the AI Action Summit in Paris, the InvestAI initiative was unveiled – with a massive investment volume of €200 billion!
Core of the Initiative:
A new €20 billion fund will finance the construction of four AI giga-factories in Europe. These facilities will be equipped with 100,000 last-generation AI chips – four times the current standard.

Objectives & Measures:
• Open to startups, research & industry
• €10 billion for existing AI factories & supercomputers
• Promotion of GenAI for robotics, healthcare, mobility & climate
• Support for AI startups & scale-ups through venture capital
• Strengthening AI talent through education & training

With InvestAI, the EU aims to create the world’s largest public-private partnership for trustworthy AI. This initiative marks the next step toward Europe’s technological sovereignty.

AI regulation: The EU AI Act came into force yesterday with initial obligations

Since February 2, 2025, the first provisions of the EU AI Act have been in force in the EU, which have a direct impact on companies and their compliance departments.

Prohibited AI practices under the EU AI Act:

Unlawful manipulation: AI systems that exploit subliminal techniques or cognitive weaknesses to significantly influence the behavior of natural persons (EU AI Act, Art. 5(1)(a), (b)).
Exploitation of vulnerabilities: AI that specifically uses individual characteristics such as age, disability or socio-economic situation to control user decisions
Unauthorized emotion recognition: The use of AI for emotion recognition in the workplace or in educational institutions, unless there is an explicit legal basis

What does this mean for compliance departments?

Testing & documentation: Companies must test AI systems for regulatory requirements and prepare a risk analysis including technical documentation.
Training and internal governance: Employees must be made aware of the new regulations and processes must be established for the legally compliant use of AI.
Minimize the risk of sanctions: Violations can lead to significant fines of up to €35 million or 7% of annual global turnover.

CS3D has been adopted by the EU!
The EU member states adopted the CS3D with a qualified majority on 14 March 2024. Although in a weakened form.

After a long struggle, the Corporate Sustainability Due Diligence Directive (CS3D) has now been adopted by the EU member states.
A decision on the CS3D was originally due to be taken on 9 February 2024, but concerns from various member states led to the Council Presidency postponing the date once again, to avoid the possibility of this regulation being rejected.
