Right to Work checks are expanding beyond traditional employees.
From 1 October 2026, the rules will also cover certain people engaged under workerβs contracts, as individual subcontractors or through online matching services.
The checking routes remain familiar. However, employers will need to identify who now falls within scope, decide who owns each check and make sure the evidence is retained.
If you use digital checks, your provider must also be registered specifically for Right to Work services.
