Supreme Court on Interim Maintenance & Adultery
The Supreme Court has ruled that a wife may not be entitled to interim maintenance if the husband is able to present prima facie (at first glance) credible evidence that she is living in an adulterous relationship. The Court clarified that lower courts should not automatically postpone deciding such objections until the final hearing. �

The judgment also makes it clear that mere allegations or suspicion are not enough. A husband must produce clear and convincing material supporting the claim before interim maintenance can be denied. If such evidence is lacking, interim maintenance cannot be refused on allegations alone. �

The ruling interprets the statutory bar under Section 125(4) of the Code of Criminal Procedure, which provides that a wife living in adultery is not entitled to maintenance. The Court emphasized that each case must be decided on its own facts and evidence.
