HOW TO END THE INCESSANT ACCIDENTS INVOLVING THE LOADING,TRANSPORTATION AND DISCHARGE OF PETROLEUM PRODUCTS THROUGH TANKER TRUCKS IN NIGERIA - KOGI STATE THROWN INTO MOURNING TODAY FROM ROAD ACCIDENT & TANKER TRUCK EXPLOSION (PART 1).
The Department of Petroleum Resources (DPR) is charged with the primary responsibility of the monitoring and control of the Oil and Gas operations in Nigeria, which include but not limited to Oil and Gas Transportation. The DPR has issued the Oils Mineral (Safety) Regulations and the Environmental Guidelines and Standards for Petroleum Industries in Nigeria (EGASPIN) and require any company that wish to operate or render services in the Oil and Gas Industry to apply and obtain a Permit from the DPR. This permit are in various categories, depending on the nature and scope of operation or services in the Petroleum Industry. These categories include (1) the General Purpose Category (2) the Major Category and (3) the Specialized Category. Please, take note that the essence of a permit is to regulate and control operations in order to eliminate the hazards associated with both the normal & abnormal operations or reduce the risk to as Low As Reasonably Practicable (ALARP) or As Low As Reasonably Achievable (ALARA). Permits issued for the transportation of oil and gas falls under the Major Category. i.e Haulage Services – Road Haulage, Petroleum Product Haulage, Domestic Waste Transportation. It therefore follows that the DPR MUST set a “necessary and enforceable” conditions for the permits issued for Petroleum Product Haulage in Nigeria. These necessary and enforceable conditions should be clearly communicated, concise and understood by the user of the permit (owners and drivers of petroleum products tanker trucks).
(1) How many of the owners and drivers of petroleum products tanker trucks are aware of the provisions of DPR Oils Mineral (Safety) Regulations and the Environmental Guidelines and Standards for Petroleum Industries in Nigeria (EGASPIN)?
(2) Does these permits issued by DPR contain “necessary and enforceable” conditions?
(3) Does the conditions contain responsibilities for emergency planning and control of major accidents?
(4) What are the responsibilities assigned on the part of the DPR to enforce the “necessary and enforceable” conditions and control major accidents involving petroleum products tanker trucks?
RECOMMENDATION
The provisions of the DPR EGASPIN in relation to Oil and Gas Transportation is as follows:
3.0 Road Tankers and Rail Wagons
(i) Standardisation of construction materials and proper operations are the major control to minimise or check accidents and leakages that will result in spillages.
(ii) Hydrocarbon emission from loading operations are generally controlled by the use of a vapour collection device manifolded into a vapour recovery unit.
(iii) Regular mandatory check on tyres and batteries before loading and haulage of tanks are carried out.
1.0 Environmental Management System.
1.1 Licencees/operators shall institute planned and integrated environmental management practices, aimed at ensuring that unforeseen, identified and unidentified environmental issues are contained and brought to an acceptable minimum.
1.2 Specific roles, responsibilities and authorities shall be defined, documented and communicated in order to facilitate effective environmental management.
As shown above, the provisions of the DPR EGASPIN in relation to Oil and Gas Transportation gives discretionary responsibility, advice and generally subjects the operators or service providers to “self-regulation”. This is the major reason for the incessant accidents involving Petroleum Products Transportation through Tanker Trucks in Nigeria.
SOLUTION
(1) The solution is to review the DPR Permit for Petroleum Product Haulage in Nigeria by removing it from the Major Category, placing it in the Specialized Category and ensure that specific, necessary and enforceable conditions are imposed on the operators or users of the permit,
(2) Nigeria Government should enact and implement the Control of Major Accident Hazards Regulations (COMAH), aimed to prevent major accidents involving dangerous substances and to limit the consequences to people and the environment of any accidents that do occur. Details will be treated in Part 2.
