You are still legally married while undergoing divorce proceedings. This means that, by default, if you pass away without a Will, the Intestate Succession Act will apply. Under this Act, with the exception of a decree of Judicial Separation (which must be filed in court), your spouse will inherit half of your estate if not all of it (if you have no issues nor parent).

To safeguard your assets and ensure they are distributed according to your wishes, it is advisable to update or draft a Will as soon as possible. Additionally, you should also update your CPF nomination and insurance nominations.

"I can't recall if I made any insurance nomination... I'll just make a Will to override them, right?" — It’s not that simple!

A Will cannot override a trust nomination, and for revocable nominations, it only works if the Will includes very specific details like the insurer’s name, policy number, beneficiary’s NRIC, address, date of birth, and allocated death benefits totalling 100%. In a court case, someone tried to rely on a Will without updating their nomination, and the payout went to the original nominee instead.

You can't simply "Will away" your frozen eggs, sperms or embryos like other assets. The use and handling of these reproductive materials are regulated. In fact, before storing them, your fertility clinic must get your instructions on whether to dispose or donate them upon your passing. Your Will typically can't override those instructions.
