Follow-up after discovering new Baysox logo has been trademarked.
HERE'S OUR TAKE:
We have become accustomed to seeing countless imitations of our original concepts. Our Citizen Pride designs are protected with official U.S. copyrights. Nobody may use our artwork, as is, without permission or a royalty agreement.
Designers know how to get around this. They make just enough alterations to the art where infringement can be avoided. In this case, the crab is different, it’s holding a baseball bat and it’s not a MD banner as we have but a full flag. In other words, it's not an "exact replica” of our art that was copyrighted with the U.S. copyright office in 2016. (You can look it up here. Registration #: vau001283853) From a copyright concern, this new Baysox mascot illustration is fine. Our concern is that the Baysox has trademarked this illustration which makes it their logo.
If not addressed now, the Chesapeake Baysox Intellectual Property (IP) attorneys could charge us with trademark infringement! Trademark infringement happens when a judge agrees that the general public could be confused by similar marks. In time, the public could assume that the artist, Joe Barsin of Citizen Pride, had “infringed” upon the Baysox trademark by selling our “Blue Crab Maryland Banner” products to the public. The public would view Joe Barsin's work as a derivative of the new Baysox logo. The rebranding of a large, established Double-A baseball club would not be easy. It’s certainly not a bad design (we know 😉). It’s fun. It works. When we see it we will smile knowing where the inspiration came from.
We have fond memories of taking our young boys to the beautiful stadium in Bowie. Moving forward, we wish much success to the newly branded Chesapeake Baysox.
