The Supreme Court has ruled that federal law does not shield freight brokers from state-level personal injury lawsuits, a decision that could reshape broker liability across the industry.

In a 9-0 decision in Montgomery v. Caribe Transport II, LLC, the Court allowed a lawsuit against C.H. Robinson to move forward after a crash involving a contracted carrier.

The Q1 2026 Risk Index Report is now available.

This quarter’s data points to a market that is moving in different directions:

⚫ Unsafe Driving alert rates continued to improve for mid-size and large fleets, while small carriers remained less consistent.
⚫Hours of Service violations also declined, suggesting stronger compliance.

At the same time, heavy-duty truck values continued to climb, with annualized price changes nearing 40%—adding more pressure to replacement and financing decisions.

The report also looks at a less visible issue: chameleon carriers. Estimates indicate that 10–20% of motor carriers may be operating under recycled identities, creating added challenges for underwriting and risk visibility.
