For 20 years, I helped insurance companies underpay injured people.

Not because I was corrupt.

Because that was the job.

I designed the claims systems built to pressure settlements before claimants understood what they were owed.

When you're inside that machine long enough, you stop seeing people. You see files. You see exposure.

But this isn’t about insurance people. Many of the smartest professionals I know work in insurance.

Adjusters are overwhelmed. Many handle hundreds of claims at once. The system pushes them to move files quickly while scrutinizing them for “overpaying.”

It’s the system that is broken...not the people.

Here's what some don't know.

Twenty years ago, fewer than 25% of injured people hired attorneys before settling. Today it's over 60% and some carriers approaching 100%.

That's not greed. That's people learning what they're up against.

When I started Precedent, I thought I could improve the process.

Build a digital bridge between attorneys and carriers. Replace faxes and mailed documents with structured data both sides could use. It worked for property damage…cars get fixed faster, everyone wins.

I had the largest personal injury law firm in America ready to go across that bridge.

Then I brought it to carriers.

One executive told me he "wouldn't hire their children's children." He said my law firm partner was a stain on America.

That was my answer.

Insurance companies don't want the bridge.

Bridges create transparency. Transparency changes leverage.

The slow, analog, obscure process isn't a bug.

It's a feature.

So we stopped trying to fix it.

We chose a side.

There are people who will never forgive me for this. I will pay a real, personal price for this choice.

But I spent 20 years inside a system designed to wear injured people down until they settle for less than they're owed.

I'm done being part of that.

Why is proper case intake so important?

In Part 1, we showed how carrier behavior varies widely.
In Part 2, we showed how one missing VIN can 4x your setup time.

Now let’s zoom out.

Across 20,000+ claim setup requests, 22% had intake quality issues — wrong carrier, invalid policy number, missing vehicle info, incorrect date of loss.

The impact is massive:
Clean submissions: 1.8 days, 4.3 actions
Intake issues: 7.5 days, 13.7 actions

That’s the difference between a claim opened before attorney review and one still stuck when the client calls for an update.

One extreme example: intake listed Farmers. Policy didn’t match. We contacted seven carrier entities over 41 days. 58 actions.
When the correct carrier — Old American Indemnity — was finally provided, the claim was already on file. One call. Adjuster assigned.

41 days lost because of one wrong field.

The pattern is consistent. The biggest drivers of preventable delay:
1. Missing vehicle info
2. Invalid policy numbers
3. Incorrect date of loss
4. Failure to reconcile data against the police report

Police reports are critical. They allow multi-validation of VINs, policy numbers, carrier names, and policyholder information. When firms collect and review the police report early, they dramatically reduce carrier mismatches and policy search failures.

The firms with the fastest setup times aren’t using magic tech or bigger teams. They have cleaner intake. One firm averaged 1.8 days across thousands of requests. Another similar firm averaged 3.1 days. The difference was validation before submission.

If you run a PI practice, intake is your highest-leverage operational lever.

Every missing or unverified field multiplies downstream effort — more calls, more waiting, more frustrated clients.

Four simple fixes:
Require VIN, make, model, year — every time
Validate carrier + policy before submission
Confirm the date of loss matches carrier records
Collect and reconcile the police report immediately
Intake quality is critical to starting off the case right.

Earlier this week, we shared data showing how different insurance carriers behave very differently during claim setup (see Part 1).

This week, we’re highlighting a specific issue that surfaced across 20,000+ claim setups: missing critical vehicle and policyholder information. 🚗📄

Across requests with intake quality issues, vehicle info — VIN, make, model, and year — was the #1 missing data point.

The impact:
• Requests missing key information averaged 7.7 days and 14 actions to close ⏳

• Clean submissions averaged 1.8 days and 4 actions ⚡

That’s a 4x delay from information that should be captured at intake.

Why does this matter?

If a vehicle or policyholder can’t be matched to the policy, the claim can’t be opened. Staff must go back to the firm, request details, wait (often days), then call again and restart the process. Sometimes the cycle repeats. 🔁

On personal auto claims, it’s frustrating.

On commercial claims, it’s a bottleneck. 🚧

With commercial policies:
• The carrier provided is sometimes incorrect
• Companies often use different carriers for different coverages
• Exact legal company name and address are required
• And in roughly 95% of commercial claims, the claim is handled by a third-party administrator (TPA)

That last point is critical. ⚠️

Most commercial claims aren’t handled by the carrier directly. They’re administered by TPAs with their own intake requirements — and they’re often difficult to reach. 📞

If you don’t have the correct insured entity information upfront, you may not even reach the right administrator...let alone open a file.

If the carrier or TPA can’t verify the insured entity, they won’t:
• Open a claim
• Assign an adjuster
• Confirm coverage

The claim stalls. 🛑

Commercial claims averaged 11.5 days to set up — nearly 6x the average for a clean personal auto request.

The driver isn’t complexity. It’s incomplete intake.

The fix isn’t complicated. It requires discipline. ✅

Your intake process should require:
• VIN, make, model, year (where applicable)
• Full legal company name
• Company address
• Correct carrier and line of coverage
• Whether a TPA is involved

Thirty seconds of diligence at intake can prevent a week of back-and-forth. 💡

Not All Carriers Are Created Equal

At Precedent, we process tens of thousands of claim setup requests each year on behalf of personal injury law firms. The data tells a clear story: the firms that set up claims fastest aren't making fewer calls. They're making the right calls, with the right information, because they understand how each carrier operates.

Here's what the data shows:

GEICO moves quickly, but roughly 60% of the time won't assign a named adjuster on the first call. Firms receive "team level" contact and have to call back the next day. Without knowing to push for a direct extension upfront, you're in a loop before the case even gets started.

Progressive doesn't assign adjusters immediately. Their standard window is 24 to 48 hours after a claim is opened. Once assigned, you still need the adjuster's direct email, fax number, and mailing address and getting those requires actually reaching that adjuster. Given caseloads and availability, that contact alone can add significant time to what should be a routine setup.

USAA presents a different challenge. Their policyholders are active duty military and veterans, and USAA takes that responsibility seriously. Before moving forward on any claim, they require verification of the policyholder's information. If that information isn't complete at intake, the process stalls. It's not a bureaucratic obstacle; it reflects the population they serve.

Go Auto has a hold time problem at scale. More than half of Go Auto requests we handle are delayed by hold times exceeding 10 minutes. This isn't an occasional bad day — it's their standard operating model.

First Chicago averages 5.7 days per claim setup, with roughly 90% of requests falling into the "slow" category. There is no shortcut. Knowing this upfront allows firms to set realistic client expectations rather than chasing a resolution that isn't coming faster.

Trisura and several regional carriers show non-responsiveness rates above 20%, with some requests requiring 30+ contact attempts — not because of anything the law firm did wrong, but because of how those carriers operate.
The firms that work with Precedent gain access to carrier-specific playbooks built from millions of data points: which numbers to call, when to escalate, and what each carrier needs before they'll open a file.

That kind of intelligence isn't something you build doing 20 setups a month. It comes from doing thousands.
