We know there’s been a lot of confusion with everything going on. I want to take a minute to walk everybody through it!
On April first Virginia’s new law kicked in. The law states we can only sell v***r products that are on Virginias registry of FDA approved v***r products.
We have done everything we can to stock as many Virginia Complaint/exempt products as possible! I’m sure most of you have noticed some different products than usual on our shelves.
We are still searching for answers on the legality of certain products. For example, refillable v**es. To be honest we’re pretty sure they’re illegal to sell! We are just not sure if Virginia will be enforcing that. We know this sounds kinda crazy. We’ve received contradicting legal advice from different agencies and none at all from the enforcers. We have contacted ABC, the commonwealth attorney general, the Virginia attorney general, the VTA, and lawyers. None of the above seem to have any surefire answer. We are extremely frustrated that answers have been impossible to obtain. We will continue to special order hardware for folks in the meantime while we wait for those answers.
Here is what’s happening now. ABC now has a fully funded v**e task force. Anywhere that sells v**es has to get a new license through ABC. The license is extremely thorough. Criminal background checks, driving records, all sorts of information needed. Right now ABC is running around telling everyone to get the license by October 1st. If you don’t get the license and sell v**e products it is a criminal offense. Not to mention the giant fines! We have been told before they issue the license shops will be inspected to make sure they’re not selling illegal products. After the license is issued you get put on a list to be inspected once every 12 months or more frequently.
We are extremely frustrated with the lack of enforcement that has happened so far. You’ve probably noticed there are still shops selling “old” non compliant products that we have pulled off our shelves. Shops like us that follow the law and try to do things legally under the threat of being shut down are losing their business to the bad actors that continue to operate illegally.
It’s not just v**es. These same bad actors continue to sell illegal THC products that we pulled from shelves years ago. Hydroxy 7 which we never sold but is now classified as a schedule 1 narcotic. It looks like Virginia is finally trimming the fat and coming after these shady places with fully funded legit enforcement on October 1st.
It’s been tough, the expensive new licensing, the loss we took on non compliant inventory, watching our customers go to other stores that sell illegal products while we comply. In our 10 years of business this has certainly been the most trying time.
We continue to position ourselves for the future. We comply because we want to be here for another 10 years. Not just a quick buck. Because it’s the right thing to do.
As the promised enforcement date of October 1st gets closer we are hopeful!
