Processes to clarify employer obligations to insure PERM positions are fully open to U.S. workers;

Application submission and review process and feasibility for efficiently addressing nonmaterial errors.

USCIS memo on President EO:

Work with the Department of State to develop a method to allocate immigrant visas to ensure that all immigrant visas authorized by Congress are issued to eligible individuals when there is sufficient demand for such visas.

Work with the Department of State to modify the Visa Bulletin system to more simply and reliably make determinations of visa availability.
Provide clarity on adjustment portability to remove unnecessary restrictions on natural career progression and general job mobility to provide relief to workers facing lengthy adjustment delays.

Finalize a rule to provide work authorization to the spouses of certain H-1B visa holders who are on the path to lawful permanent resident status.

Work with Immigration and Customs Enforcement (ICE) to develop regulations for notice and comment to expand and extend the use of optional practical training (OPT) for foreign students, consistent with existing law.

DHS memo on President EO :

USCIS is to publish the final rule implementing the availability of Employment Authorization for H-4 visa holders. Since this rule was already proposed several months ago, the effective date should be relatively soon. The I-765 form will need to be updated to create a new category for H-4 dependents. Guidance will need to be published by USCIS to confirm exactly who is eligible for the EAD and what documents must be submitted.

USCIS and Department of State are to improve coordination to better ensure that all authorized immigrant visas (green cards) are issued each year. Furthermore, Department of State will be making changes to the visa bulletin system to more reliably anticipate visa demand and move the priority dates appropriately.


USCIS is to “carefully consider other regulatory or policy changes” for beneficiaries of approved employment-based immigrant visa petitions. This likely refers to the possibility that those with approved I-140s may be able to file the I-485 Adjustment of Status now, even if the priority date is not current. While the I-485 cannot be approved without a current priority date, this step will provide 2 specific benefits: 1. The ability to obtain an EAD and no longer rely on the underlying nonimmigrant visa; and 2. The ability to change jobs under AC-21. Because this may require changes in regulations, it could take several months for these changes to be implemented. Although the idea of advancing the ability of individuals with an approved I-140 to file the I-485 is not specifically mentioned in Secretary Johnson’s memo
