One of The Laundromat's most quoted lines reduces the distinction between tax avoidance and evasion to something as thin as a jailhouse wall.

It's a joke. But it's also the exact problem the industry spent the last decade solving.

For years, the avoidance/evasion "thin wall" was navigable mainly because visibility was scarce. Beneficial ownership could be obscured through nominee structures and layered entities across non-cooperative jurisdictions, and self-reported information had no external verification mechanism.

CRS and FATCA don't resolve the philosophical question of where avoidance ends and evasion begins. They changed the underlying condition, not the legal definitions.

Automatic exchange of financial account information across 100+ participating jurisdictions means the ambiguity the film dramatizes now operates under continuous cross-border visibility rather than in the dark.

The wall didn't move. The lighting did.

Un nuevo estudio de la OCDE responde qué ocurrió realmente ahora que el Impuesto Mínimo Global (GMT) se convirtió en ley, con cifras reales en lugar de proyecciones.

Las empresas sujetas al GMT vieron aumentar sus tasas impositivas efectivas entre 1,4 y 1,7 puntos porcentuales en 2024, impulsadas por empresas multinacionales (EMN) en sectores más propensos a la planificación fiscal y aquellas con mayores proporciones de activos intangibles. La sorpresa más importante: no se observó una caída medible en la inversión ni en el empleo. Las empresas pagaron más impuestos sin reducir la contratación ni el gasto de capital, al menos hasta ahora. A nivel global, se estima que la reforma generó entre EUR 79 mil millones y EUR 109 mil millones en ingresos fiscales adicionales durante su primer año.

Se trata de datos preliminares, y los autores advierten que los efectos podrían cambiar a medida que más jurisdicciones completen la implementación y se reduzcan gradualmente las exenciones. Pero para los equipos de cumplimiento que siguen de cerca la interacción entre el AEOI y los marcos de impuesto mínimo, esta es la primera evidencia sólida con la que trabajar.
