ZUMR RIDESHARE TERMS & CONDITIONS

1. Introduction
Welcome to ZUMR Rideshare (“ZUMR”), a technology platform owned and operated by Sumer Technologies Inc., a Delaware corporation with its principal address at 7910 Dartmoor Pl, Port To***co, MD 20677. These Terms and Conditions (“Terms”) govern your access to and use of the ZUMR mobile application, website, and related services (collectively, the “Platform”). By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, you may not use ZUMR.
2. Nature of the Service
ZUMR provides a digital marketplace where riders seeking transportation can connect with independent drivers who offer ride services. ZUMR is not a transportation carrier, employer, or agent for any driver. ZUMR does not own, operate, or control vehicles and does not guarantee the safety, quality, or reliability of any ride or driver.
3. Driver Responsibilities
Drivers using ZUMR acknowledge that they are independent contractors and not employees, agents, or partners of ZUMR. Drivers are solely responsible for maintaining valid driver’s licenses, vehicle registrations, and auto insurance as required by law. Drivers must operate their vehicles safely, comply with all applicable traffic laws, and treat riders with courtesy and professionalism.
4. Rider Responsibilities
Riders agree to provide accurate account information, comply with community standards, and treat drivers respectfully. Riders must pay all applicable fares, taxes, and fees through the Platform. Abuse, harassment, fraud, or non-payment may result in suspension or termination of a user account.
5. Payments and Fees
Fare amounts are calculated based on factors such as base rate, distance, time, and applicable fees. ZUMR facilitates payment processing between riders and drivers through third-party providers such as Apple Pay or Cash App. Drivers retain 100% of their earned trip fare. ZUMR may charge riders a service or convenience fee. All transactions are final unless otherwise specified by ZUMR’s refund policy.
6. Insurance and Safety
Drivers are required to maintain insurance coverage that meets or exceeds state minimum requirements. ZUMR is not an insurer and does not provide personal or vehicle insurance to users. ZUMR may offer optional contingent coverage as permitted by law. Drivers and riders are encouraged to verify coverage with their providers.
7. Disclaimer and Limitation of Liability
ZUMR provides the Platform on an 'as is' and 'as available' basis without warranties of any kind. To the maximum extent permitted by law, Sumer Technologies Inc. and its affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Platform or participation in any rides. ZUMR is not responsible for accidents, injuries, lost property, or misconduct by users.
8. Dispute Resolution and Arbitration
Any dispute, claim, or controversy arising from or relating to these Terms shall be resolved through binding arbitration conducted in the State of Maryland under the rules of the American Arbitration Association. Each party waives the right to a jury trial or class action. The governing law of these Terms shall be the laws of the State of Delaware.
9. Privacy and Data Use
By using ZUMR, you consent to the collection, use, and disclosure of personal data as described in our Privacy Policy. ZUMR collects information including but not limited to your name, contact details, location data, and transaction history to improve service quality and security.
10. Account Termination
ZUMR reserves the right to suspend or terminate accounts at its sole discretion for violations of these Terms or misuse of the Platform. Users may terminate their accounts at any time by contacting support at [email protected]. Certain obligations, including payment and indemnification, shall survive termination.
11. Intellectual Property
All intellectual property rights in the ZUMR Platform, including software, trademarks, graphics, and logos, are owned by Sumer Technologies Inc. Users are prohibited from reproducing, modifying, or reverse-engineering any aspect of the Platform.
12. Community Standards and Conduct
All users must uphold ZUMR’s community values of respect, safety, and fairness. Any acts of violence, discrimination, or harassment are strictly prohibited. ZUMR reserves the right to remove or ban any user who violates these standards.
13. Updates and Modifications
ZUMR may amend these Terms at any time. Users will be notified of significant changes via email or app notifications. Continued use of the Platform after such changes constitutes acceptance of the updated Terms.
