Referral eligibility remains one of the more nuanced areas of 340B compliance.
HRSA's patient definition guidance does not provide a separate, prescriptive test specifically for referrals. Instead, covered entities must be able to demonstrate that an individual meets 340B patient eligibility requirements, including maintaining appropriate health records and, when care is provided through a referral or other arrangement, that responsibility for the patient's care remains with the covered entity.
