Electronic Document Review (EDR) is based on a simple premise. Before any legal case, it’s important to understand what should be included in a case, what is irrelevant and what is privileged. The information that surfaces during this process will also help the legal team choose whether to litigate or settle, and – if litigation is the decision – to devise the best legal strategy to win the case. From a forensic investigation point of view, the primary objective is very similar, but might not entail privileged data. Instead, digital forensics is more focused on identifying evidence to assist with the investigation and to assist in identifying additional avenues to investigate or pursue.

However, given the complexity and volume of data today, all of this is extremely (if not insurmountable) difficult without the support of technology. According to a recent study by the Association of Certified E-Discovery Specialists (ACEDS), the average case contains 6.5 M Pages, 10 to 15 Custodians, and 130 GB of data.

To try and put that into context, consider that one GB is approximately 100 000 pages of emails, 65 000 Word document pages, or about 678 000 text files per gigabyte. It’s an overwhelming amount of data and no wonder that relevant documents are not disclosed and non-relevant documents slip through. Without technology assisted document review, it can be difficult tagging, classifying and reviewing so much content, especially when the data is in so many different formats, including documents, emails, databases, presentations, texts, WhatsApps, voicemail, audio and video files, collaboration message boards, social media, and web sites.

If eDiscovery is the single biggest cost in a legal case, the review and analysis phase is the most expensive in the eDiscovery process. According to a study published by the Rand Corporation, 73% of all eDiscovery expenses go towards reviewing electronic documents. This might prompt some businesses to believe that eDiscovery – and Electronic Document Review in particular – are too costly.

The reality is that in today’s big-data driven world, it is far more costly to not invest in technology. The right technology solutions streamline processes, eradicate errors and can handle the how much data the average case entails – which in South Africa is upwards of 5 GBs of data.

Traditional, legacy review technology still relies on linear review (particularly in South Africa), which is extremely time-consuming, as the process starts with the first document and moves chronologically through the documents in the data-set. More advanced technology, on the other hand, permits nonlinear review, with reviewers categorising and clustering data based on concept and context, drastically improving review speeds and allowing reviewers to focus on a given topic.

So, your business has a data collection, storage and usage policy in place, but what about a deletion policy?

In our experience, many companies miss this step, particularly because the regulations surrounding data protection and management are relatively new. However, adequately managing data means that it must not only be stored correctly but also deleted correctly. This is because businesses cannot keep creating and storing big data indefinitely – at some point files must be deleted. But how, when and in what manner? And most importantly, will you be able to defend the deletion in a court of law? In other words, is your policy ‘defensible’?

To create a plan for defensible deletion, include clearly understood preservation obligations and an adherence to record retention schedules. Remember, businesses are required to keep data for a variety of legitimate reasons, including regulatory compliance, legal obligations and records management. When data has outlived its business purpose, however, and has become aged, redundant, or obsolete, best practice states it should be deleted.

eDiscovery is fast becoming a must-have in South African legal cases, but it is also seen as the single most costly element in litigation. This is because not only must all relevant documents be found, reviewed and shared, but organisations are striving to increase visibility into the entire process and its associated costs. This is critical to improve outcomes, streamline IT processes and leverage technology assisted discovery to accomplish more in less time and at a lower cost.

The key to achieving all of the above is proactive information governance. Remember, every element of electronically stored information (ESI) is potentially an asset – and any piece of information could be subject to a legal hold. Businesses must therefore understand:

The World Economic Forum estimates that by 2025, 463 exabytes of data will be created each day globally. Let’s put that intro context. Each day in 2019, 500 million tweets were sent, 294 billion emails, and 65 billion WhatsApp messages. 4 petabytes of data were created on Facebook, and 5 billion online searches were made. One can only imagine how exponentially those figures have grown since the pandemic.

What’s more, this big data isn’t only ‘big’ – it’s extremely complex. Oracle categorises big data according to the three Vs: it contains greater variety, arrives in increasing volumes and has more velocity. In other words, big data is being generated all around us, hard and fast. Here’s the challenge. Without the proper governance in place, it is impossible to manage.
