1. Common Law: Right of Admission Reserved
" Freedom of Association: Section 18 of the Constitution supports the business owner's right to choose whom they wish to associate with or enter into a contract with, provided the choice is not unlawfully discriminatory. "
2. Consumer Protection Act (CPA) 68 of 2008
" Unconscionable Conduct: Section 40 prohibits suppliers from using physical force, coercion, or harassment against consumers. By extension, businesses can refuse service to prevent such conduct from being directed at their staff. "
Fairness and Equality: While the CPA prohibits unfair discrimination (Section 8), a refusal based on hostile behavior is considered a legitimate business decision rather than a prohibited ground of discrimination (like race or gender).
3. Promotion of Equality and Prevention of Unfair Discrimination Act (PEPUDA) 4 of 2000
Hostility as a Grounds for Refusal: Hostility or aggressive behavior is not a protected ground. Therefore, refusing service to a hostile customer is not "unfair discrimination" under Section 14 of the Equality Act.
1. Common Law: Exceptio Non Adimpleti Contractus
Right to Withhold: If a customer defaults on payment, the service provider has a legal right to suspend or withhold further services until payment is made, even if the contract does not explicitly state this.
Breach of Contract: Non-payment constitutes a breach of contract (mora debitoris), allowing the innocent party to cancel the agreement and claim damages.
