You don't have to wait on OEMs to comply with the FTC's Deceptive Advertising Act. There's action you can take today.
1️⃣ Audit your pricing. Pull up every unit listing on your site. Does the price include freight and setup? If not, the NPDA's own guidance is clear, advertise the all-inclusive, out-the-door price. No exceptions.
2️⃣ Disclose what varies. Marine especially... if fees shift based on configuration, say so upfront. Spell out what's included and what isn't. The F&I office should never be where a buyer learns about a fee for the first time.
3️⃣ Train your team on the "why." Price transparency shouldn't feel like playing defense. It's a value prop. "We show you the real price upfront because we respect your time and your budget" helps close deals.

None of this requires waiting for manufacturers to restructure MSRP. It requires a website that gives buyers real numbers before they ever walk in... trade values, payment estimates, the works.
That's the difference between a buyer who shows up ready to negotiate fees and one who shows up ready to buy.

The FTC lost the CARS Rule in court, but the FTC still has full authority under Section 5 of the FTC Act to go after deceptive pricing. Enforcement didn't stop. It just shifted.
And for powersports, the NPDA has made the current reality crystal clear: all states now require all-in advertised pricing. No exceptions.
That means if your website shows the MSRP and your F&I office reveals the freight and setup fees, you're exposed.
Dealers didn't create this problem. OEMs publish an MSRP that excludes freight, charge dealers for it anyway, and then let you take the heat when buyers show up expecting that number.
The NPDA is pushing manufacturers to fix this by folding freight into MSRP, reimburse dealers for setup, and create a level playing field.
Until OEMs catch up, dealers are left with a choice: show the real price and look expensive, or hide the fees and stay exposed.
There is a third option. Show the real price AND give buyers enough upfront like trade values, payment estimates, and real numbers, that they walk in ready to deal instead of ready to walk out.

Your dealership isn't growing and most dealers assume the problem is budget, or inventory, or the market.
It's almost never any of those things.
Business expert Alex Hormozi calls it the "Mosy 6" reasons a business can't grow. Here's what they look like inside a dealership:

1. Market 🗺️
The market isn't your problem. Millions of people are shopping for RVs, boats, and powersports units. The real issue is not enough of them know you exist or they visited your site and left before you gave them a reason to stay.
2. Metrics 📊
Can you tell which campaign drove your last lead? Do you know your website conversion rate? Your cost per lead by channel? If not, you're guessing.
3. Model 🔧
