From what I can tell, copyright enforcement is about to be messy and more difficult for many, many people. The Supreme Court declined to consider if AI created content can be copyrighted, in effect leaving in effect the requirement of human authorship. In short, AI created content is not copyright protect. Well, well, well, isn't that a fine basket we now have to work with. All those fancy stories, images, videos and soundtracks from AI are not protected by copyright.

The US Supreme Court has declined to consider the copyrightability of artwork generated purely autonomously by artificial intelligence, leaving in place the “human authorship requirement” for copyright protection. In this LawFlash, we break down the case, the statutory and judicial frameworks go...

There is a clear difference between being informed by AI and allowing AI to define who we are. Humans are intelligent beings. We are designed to act, not to be acted upon - although that does get messy and confusing in today's society. AI, however, is a collection of objects, even to be acted upon. Agentic AI will make this distinction increasingly difficult to tell the difference, but at the core, we are not the same. Humans have discernment, compassion and feelings. AI does not. We must clearly understand and be able to tell the difference as technology continues to advance.

One of the realties of deception is the inclusion of data in real photos in order to cast doubt on the authenticity of the original photo. Bad actors can take a real photo, insert or make a small AI-assisted edit and then authenticate the photo as AI generated with credentials from Content Provenance and Authenticity (C2PA). This discredits and casts doubt on the original work and is one more reason why we embrace human-in-the-middle processes. Relying solely on AI without multiple check points and no human review is a fundamental exposure point for deception. https://campustechnology.com/articles/2026/02/25/report-no-foolproof-method-exists-for-detecting-ai-generated-media.aspx

Word count. We work with people talking to people so most of the data we use for AI detection happens in short bursts. Our competitors? Looking at three of them today, they won't scan on anything less than 80-100 words and recommend 300 or more. Well, no kidding, the more words to work with the more accuracy you get. Accuracy on AI detection on text goes way up when working with long form text. This is one of the benefits of using our Chrome extension - it will take conversations that happen over hours, days, weeks and months. More is simply better.

I received an email the other day from a security company. They made the following statement: "Benign and malicious bots exhibit nearly identical behavioral patterns, making static rules unreliable." We agree with them. AI bots will increasingly become more human with greater capabilities to imitate human behavior. Observing and analyzing bot behavior is only part of the equation and static rules are not the answer.

One of my old associates called today. In the course of the call he made the statement that sales is all about "guiding someone through the emotional process of decision making." He was keen to observe, AI does not have a soul, it has no emotion.

Both of these encounters point to the same conclusion: AI doesn't care. It has no soul. AI doesn't have emotions. It is artificial and decidedly different than humanity - and that can be detected.

Tools like AI TruthTeller are helpful, but each of us as humans must discern the difference. We can feel what is real and what is not.

The subtleties of AI are very real and can be very misleading. I came across a short essay today posted with the picture below liberally quoting and referencing Bill Gates in order to provide credibility. The entire post was written by AI and the headline below is substantially misleading and untrue. Bill Gates, factually started an investment fund called Breakthrough Energy Ventures. This fund has indeed invested in a company that is creating lab grown butter (Savor). Gates however is not involved in management of the lab company. In addition, Savor, the company is working to obtain FDA clearance and bring the lab butter to market next year. Bringing a product to market is a far cry from replacing traditional butter by 2027. Gates' fund owns a minority share in the company.

Part of the problem in this example, is that AI can find numerous examples of web sites and posts replicating the falsehood. These many rumors then become the basis for AI regarding this as a truthful statement. Hence the headline and the untruth being perpetuated.

Confluent, a company with roots in data transformation is releasing products built as "streaming agents, using an "Agent2Agent protocol to trigger and coordinate external AI agents using real-time streams." Sean Falconer, their Head of AI, says, "You need a system of AI agents that work together and constantly learn and share insights in real time. Confluent Intelligence connects...AI investments and systems no matter where they're built-so AI can automatically react to live data, take action, coordinate systems...if you want to be competitive you can't have your AI looking in the rearview mirror."

Really? This seems like a terrible idea for more than a few reasons. No reason to learn from the past, react only in the moment and give AI agents autonomy to take action and coordinate external AI agents - without human intervention. I'm sure this will be useful in many environments (military comes to mind at the moment), but it will create disaster in others.

When you interact with online agents, chatbots and the like, make note, the agent may not be acting solo but can be part of a coordinated team effort. An effort to move you toward their pre-determined objective. More detail can be found here: https://itbrief.co.uk/story/confluent-links-ai-agents-boosts-anomaly-detection

Research is on my mind. Especially the research recently released by Microsoft on the challenges related to AI detection. We know very well that AI detection is a process and not a quick and easy conclusion. Although we promote AI TruthTeller® as a useful tool, development is an ongoing process. Microsoft Research does a great job of identifying a few of the gaps in the process of AI detection. Cryptographic provenance, watermarking, and soft-hash
fingerprinting all have their shortcomings and exposures. Fortunately, we are working on a process that we think will supersede each of these approaches. Time will tell if we are right or not.
